Conveyancing for Property Sellers in Balwyn
Section 32 statements, contracts and settlement for vendors
A successful sale starts with accurate documents. Grice Legal prepares your Section 32 vendor statement and contract of sale, advises on offers and special conditions, and manages the steps through to settlement. We also assist executors selling estate property and separating couples selling a jointly owned home.
How we help sellers
We obtain the required certificates and prepare an accurate vendor statement, so it is ready before your property is marketed.
Section 32 vendor statement
We handle deposit release requests, mortgage discharge, any required clearance certificate, and adjustment calculations.
Pre-settlement steps
We prepare the contract, including appropriate special conditions, and work with your agent so the documents suit your sale method.
Contract of sale
We assist executors and administrators selling estate property and couples separating and selling a jointly owned home, coordinating the related legal steps.
Estate and separation sales
We explain the effect of proposed changes to price, deposit, settlement date or conditions before you accept an offer.
Advice on offers and terms
We complete settlement electronically and confirm when the sale proceeds have been paid as directed.
Settlement
Most sales follow these steps, although the timing depends on your sale method and the contract terms
Conveyancing costs for sellers
Once we understand your property and the assistance you need, we will discuss the likely costs with you and provide the required costs disclosure. This explains how our fees will be calculated and gives you an estimate of the likely legal costs, based on the information then available.
The estimate will identify likely disbursements, such as the certificates needed for the Section 32 statement. If the sale becomes more complex, for example because of a title issue or a buyer default, we will discuss any material change in the likely costs with you.

Property Sale FAQs
-
As soon as you decide to sell, ideally when you appoint an agent. The Section 32 statement and contract should be ready before the property is marketed, and preparing them can take some time because certificates must be obtained from several authorities.
-
Depending on the error, a buyer may be able to end the contract before settlement and recover their deposit. Careful preparation reduces this risk. If something changes after the statement is prepared, tell us promptly so we can consider whether further disclosure is needed.
-
Generally, yes. Under the foreign resident capital gains withholding rules, a buyer must withhold an amount from the price and pay it to the Australian Taxation Office unless the seller provides a clearance certificate. These rules now apply regardless of the sale price. Australian residents can apply online, and it is sensible to apply early.
-
Possibly. The Sale of Land Act allows the deposit to be released early in some circumstances, provided certain conditions are met and the buyer does not object on valid grounds. We can tell you whether early release is likely to be available on your sale.
-
Your lender discharges the mortgage at settlement from the sale proceeds. Lenders need advance notice, so we recommend arranging the discharge request as soon as the contract is signed.
-
Council rates, water charges, owners corporation fees and, in some cases, land tax are adjusted at settlement so each party pays their share for the period they own the property. We calculate the adjustments and include them in the settlement figures.
-
An executor can often market the property and sign a contract before the grant, but settlement generally cannot occur until probate has been granted and the executor can deal with the title. The contract should allow enough time. We coordinate the sale with the estate administration.
-
The contract usually allows the seller to charge interest and, after serving a valid default notice, to end the contract and keep the deposit or claim damages. The right response depends on the circumstances, so obtain advice before taking any step.
-
Yes, if both owners agree, or if the court orders a sale. Both owners usually need to sign the agency agreement and contract. It is important to agree, preferably in writing, how the sale proceeds will be held or divided pending a property settlement.
-
Yes. A private sale is possible, but you still need a properly prepared Section 32 statement and contract of sale, and you will need to manage marketing and negotiations yourself. We can prepare the documents and advise you during negotiations.
